Trees and Planning
Carrying out works to and felling trees does not in itself require planning permission. However, trees may be affected by a proposed development and be protected (see Trees and their Statutory Protection).
Trees and Planning
As part of a planning application it may be necessary to provide details of trees that are affected by the development and how they will be protected. The survey should be carried out by a qualified Arboriculturist in accordance with British Standards guide for Trees in Relation to Construction. The presence of any trees can be regarded as a material consideration in the decision making process for whether planning permission should be granted for the proposed development.
The Town and Country Planning Act 1990 makes it a duty of the Local Planning Authority to ensure that in granting planning permission that adequate provision is made for the protection and planting of trees. This can be done through the use of planning conditions and/or Tree Preservation Orders.
