Badgers and their setts are protected under the Badgers Act 1992. Development near to an active sett may require a licence in order to ensure that extra care is taken during and after construction to protect the sett and the badgers living there.
Badger sett are often found in woodland, woodland edges and alongside railway embankments and road verges. The protection of the sett extends some distance past what may be seen on the surface and construction work may need to be altered to reduce the impact on the badgers in the sett. Badgers are creatures of habit and forage and roam along regularly used paths. These might also cross a proposed development site so that provisions might also be required to accommodate or temporarily exclude badgers there. This might also require a licence.
